  • Some services may be carried out by third-party providers we engage or refer to (“Service Providers”).

  • We may present ourselves as your main contact, but the actual services may be delivered by these Service Providers, who act as independent contractors and are not our employees, partners, or agents.

  • We do not guarantee or take responsibility for the quality, timing, or legality of services provided by Service Providers.

  • Your engagement with Service Providers may also be subject to their own terms and conditions.

5. Intellectual Property & Proprietary Materials

  • All content and materials produced by Zinc Studio — including but not limited to designs, drawings, sketches, concepts, specifications, floorplans, layouts, reports, proposals, documents, text, images, logos, and software — whether provided through our website, during consultations, or as part of our services, remain the exclusive property of Zinc Studio.

  • You are granted a limited, personal licence to view such materials solely for the purpose of assessing or engaging our services.

  • You must not share, copy, distribute, disclose, or provide our designs, floorplans, or other proprietary materials to any other supplier, builder, consultant, or third party without our prior written consent.

  • Any unauthorised use, disclosure, or replication of our intellectual property is strictly prohibited and may result in legal action.

6. Liability Exclusion

  • To the maximum extent permitted by law, we exclude all liability for any loss, damage, cost, or expense (including indirect or consequential loss) arising from or connected with:

    • reliance on information provided on our website or through our services;

    • the acts or omissions of Service Providers;

    • delays or failures in obtaining approvals, permits, or consents;

    • circumstances beyond our reasonable control.

  • Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (ACL) or any other law that cannot be excluded.

  • Where liability cannot be excluded under law, our total liability is limited to the lesser of:

    • AUD $1,000; or

    • the amount paid by you to us for the relevant service giving rise to the claim.

  • services performed by Service Providers;

  • any unauthorised use or disclosure of our intellectual property or proprietary materials.

  • We do not guarantee that approvals, permits, or consents will be obtained.

  • Any timelines provided are estimates only and may change.

  • Representations regarding compliance or approvals are indicative only and not binding.

  • We may collect personal details such as your name, contact information, and project details when you interact with our website or services.
